Terms of Service

1. Acceptance of Terms

By accessing or using Sarvavidhi ("the Service", "we", "our", or "us"), available at sarvavidhi.com, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an agency or organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service. Continued use of Sarvavidhi after any updates to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

Sarvavidhi is an AI-powered social media management platform designed for digital marketing agencies and their clients. The Service provides tools to:

  • Schedule and publish posts to Facebook, Instagram, Twitter/X, LinkedIn, and YouTube.
  • Manage multiple client workspaces within a single agency account.
  • Generate AI-assisted content plans using Google Gemini.
  • Run automated email drip campaigns via Brevo.
  • Send automated WhatsApp messages via the Meta WhatsApp Business API.
  • Track post scheduling, publishing status, and basic analytics.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable prior notice where practicable.

3. User Responsibilities

3.1 Content Ownership and Rights

You are solely responsible for all content you create, upload, schedule, or publish through Sarvavidhi. You represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to post any content you schedule through the Service.
  • Your content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights.
  • You have obtained any required consents from individuals appearing in your content.

3.2 Compliance with Third-Party Platform Policies

You agree to comply with the terms and policies of all third-party platforms you connect to Sarvavidhi, including but not limited to:

  • Meta: Facebook Platform Terms, Instagram Platform Policy, Meta Business Tools Terms, and WhatsApp Business Policy.
  • Twitter / X: Twitter Developer Agreement and Policy, and Twitter Rules.
  • LinkedIn: LinkedIn Developer Program Terms and LinkedIn User Agreement.
  • Google / YouTube: Google API Services User Data Policy and YouTube Terms of Service.

Violations of these platform policies may result in suspension of your connected accounts by those platforms. Sarvavidhi bears no liability for such suspensions.

3.3 Prohibited Uses

You must not use Sarvavidhi to:

  • Send spam, unsolicited bulk messages, or content that violates anti-spam laws.
  • Post content that is unlawful, defamatory, obscene, harassing, threatening, or fraudulent.
  • Publish content that promotes hate speech, violence, or discrimination.
  • Violate any applicable local, national, or international law or regulation.
  • Impersonate any person, entity, or brand without authorization.
  • Circumvent or attempt to circumvent any platform-imposed rate limits or API restrictions.
  • Use automated means to access the Service in a manner that exceeds reasonable usage or places undue burden on our systems.

3.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@sarvavidhi.com if you suspect unauthorized access.

4. Account Termination

Sarvavidhi reserves the right to suspend or permanently terminate your account, without prior notice, if we determine in our sole discretion that you have:

  • Violated these Terms of Service.
  • Breached the terms or policies of any connected third-party platform.
  • Engaged in fraudulent, abusive, or illegal activity through the Service.
  • Used the Service in a way that causes harm to Sarvavidhi, other users, or third parties.

You may also terminate your account at any time by contacting support@sarvavidhi.com. Upon termination, your right to access and use the Service ceases immediately.

Termination does not affect any rights or obligations that accrued prior to the termination date. Provisions of these Terms that by their nature should survive termination (including Sections 5, 7, and 8) shall survive.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Sarvavidhi and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Without limiting the foregoing, Sarvavidhi is specifically not liable for:

  • Failed or delayed posts caused by changes to third-party platform APIs, including changes to Meta, Twitter/X, LinkedIn, or YouTube APIs.
  • OAuth token expiry or revocation by connected platforms, which may interrupt scheduled publishing.
  • Platform downtime or outages at Meta, Twitter/X, LinkedIn, Google, or any other third-party service that prevents content from being published.
  • Content rejected by third-party platforms due to their own policies or moderation systems.
  • Loss of data resulting from third-party service outages, database incidents beyond our control, or user error.
  • Loss of business, revenue, or reputation resulting from scheduling failures or platform API changes.

Our total cumulative liability to you for any claim arising under these Terms shall not exceed the amount paid by you to Sarvavidhi in the three months preceding the claim, or ₹500 (Indian Rupees five hundred), whichever is greater.

6. Third-Party Platforms

The Service allows you to connect and interact with third-party social media platforms. By connecting any such platform to Sarvavidhi, you acknowledge and agree that:

  • Your use of those platforms is governed exclusively by that platform's own terms of service, privacy policy, and developer policies.
  • Sarvavidhi is not affiliated with, endorsed by, or sponsored by Meta, Twitter/X, LinkedIn, Google, or YouTube.
  • Third-party platforms may change their APIs, policies, or features at any time, which may affect the functionality of Sarvavidhi.
  • You grant Sarvavidhi permission to act on your behalf on these platforms only to the extent necessary to provide the Service (e.g., publishing posts you schedule).
  • You can revoke Sarvavidhi's access to any connected platform at any time through that platform's settings or through your Sarvavidhi account settings.

Sarvavidhi is not responsible for the availability, reliability, or conduct of any third-party platform and makes no warranties regarding continued access to or functionality of third-party platform integrations.

7. Intellectual Property

7.1 Your Content

You retain full ownership of all content you create, upload, or schedule through Sarvavidhi ("User Content"). By using the Service, you grant Sarvavidhi a limited, non-exclusive, royalty-free license to store, process, and transmit your User Content solely for the purpose of providing the Service to you (e.g., storing scheduled posts and publishing them to connected platforms on your behalf).

This license terminates when you delete the content or terminate your account. We do not claim ownership over your content and will not use it for any purpose beyond operating the Service.

7.2 Sarvavidhi's Intellectual Property

The Sarvavidhi platform, including its software, design, trademarks, logos, and all associated intellectual property, is owned by Sarvavidhi and protected under applicable Indian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

7.3 AI-Generated Content

Content generated through our AI features (powered by Google Gemini) is provided to you for your use. You are responsible for reviewing AI-generated content before publishing and ensuring it meets your standards and does not violate applicable laws or platform policies.

8. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and other applicable Indian legislation, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of Sarvavidhi shall be subject to the exclusive jurisdiction of the courts in India. By using the Service, you consent to the personal jurisdiction of such courts and waive any objection to proceedings in such courts.

9. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our Service, applicable law, or business practices. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Notify active users via email at least 7 days before material changes take effect.

Your continued use of Sarvavidhi after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion by contacting support@sarvavidhi.com.
